Have you ever gone after the back hoe operator's company?

Have you ever gone after the back hoe operator's company?

We've had this happen a few times over the years in Liberty Village.  Usually it's because the survey is out of date and hasn't been updated to include the lines, either that or its a work now, apologize later situation.
Usually once this happens though, I'm told they are usually advised to use some pressurized water excavation system for further excavation.

I suspect it would turn into a fruitless endeavour,  but has anyone gone after a company who's backhoe operator broke fibre which was servicing your company resulting in lost revenue?


There is some work being done down the road from us (condos of course),   they were digging and broke a conduit carrying several hundred strands,  one of which was ours.  We were down all day because of it.


So now some folks are wondering if there are options to seek compensation.    


Just wondering if anyone in Canada/USA has been successful with something like this.
